Terms and Conditions
1. ACCEPTANCE OF TERMS
These Terms and Conditions ("Terms") are a binding agreement between you and Jagigs ("Jagigs", "we", "us", "our"), governing your access to and use of the Jagigs mobile application and related services (the "Platform"). By tapping "I Agree," creating an account, or otherwise using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, you must not use the Platform.
This is version 3 of these Terms. It replaces version 2 and applies from the date you accept it.
2. ELIGIBILITY
You must be at least 18 years old to create an account or use the Platform. By using the Platform, you represent that you are 18 or older and that you have the legal capacity to enter into this agreement. Jagigs may refuse service to, or terminate the account of, anyone it reasonably believes does not meet this requirement.
3. WHAT JAGIGS IS
Jagigs is a technology platform that connects two kinds of users:
"Clients": people or organisations looking to book entertainment or event talent (e.g. DJs, MCs, musicians, and similar service providers) for an event.
"Talents": independent service providers who list their services on the Platform and accept bookings from Clients.
Jagigs' role is to operate the marketplace: it lets Talents list their services, lets Clients discover and book them, facilitates payment for bookings, provides in app messaging, and provides related tools (scheduling, availability checks, location search, ratings, dispute handling, group bookings, and so on). Jagigs does not itself provide entertainment or event services. The actual service booked, meaning the performance, appearance, or other service a Talent provides at a Client's event, is provided solely by that Talent, directly to that Client.
4. ACCOUNTS AND SIGN-IN
4.1 Your information. You are responsible for the accuracy of the information you provide when creating and maintaining your account, including your name, contact details, and Mobile Money details. Jagigs does not ask for or collect ID numbers or identification documents.
4.2 Your address. When you sign up or edit your profile, you choose your address from a map search or from your device's current location. It must be a genuine address where you live or work from. It is used to show Clients how far a Talent is from them and to let users search by location (see Section 7).
4.3 Keeping your account secure. You are responsible for safeguarding your password and your devices, and for all activity on your account. Each device you sign in on stays signed in until you log out, or until it has not been used for 90 days. If you forget your password, you can reset it in the app using a one-time code sent to your registered email address; the code expires after a short time and can only be used once, and resetting your password signs your account out on every device. You must notify us promptly at support@jagigs.com of any unauthorised use of your account.
4.4 One account, two roles. A single account may act as both a Client (booking Talents) and a Talent (listing and accepting gigs). Where these Terms refer to "you" as a Client or a Talent, they apply to whichever role you are acting in at the time.
5. HOW PAYMENT WORKS
5.1 Payments are made to Jagigs, not held for a Talent. When a Client books a Talent and completes payment through the Platform, that payment is made to Jagigs, and Jagigs is the party the Client is contracting with and paying, in consideration for Jagigs operating the Platform, facilitating that booking, and handling payment processing. Jagigs does not act as a payment collection agent, escrow agent, custodian, or trustee for any Talent, and does not hold, safeguard, or pass through any Client's payment on a Talent's behalf. At no point is any amount paid by a Client held for the benefit of, or owed in trust to, a Talent.
5.2 Jagigs separately pays Talents. Following the completion, cancellation, or other resolution of a booking under these Terms, Jagigs may make a separate payment to the relevant Talent, calculated under Jagigs' payment policy then in effect (summarised in Section 6 below). Any such payment is made by Jagigs, from Jagigs' own funds, as its own compensation to that Talent for services rendered under the independent contractor relationship described in Section 11. It is not the Client's money being forwarded, released, or passed through to the Talent.
5.3 Payment processing. Payments are collected through a licensed third party payment service provider (currently Paystack). Jagigs does not store your full card details; these are handled directly by our payment processor under its own terms and security standards. Payouts to Talents, and any refunds to Clients, are made by direct transfer to the recipient's registered Mobile Money account, so you must keep your Mobile Money details correct. Jagigs does not maintain an in app wallet or stored balance for any user; Jagigs holds no user funds outside the ordinary course of processing a specific transaction. Clients and Talents are notified when a payment is confirmed.
6. BOOKINGS, FEES, CANCELLATIONS, REFUNDS AND MISSED GIGS
6.1 When a Talent can be booked. A booking request is only accepted by the Platform if the Talent is available for the whole of the requested time: on a day and in a time window the Talent has marked as available (morning: 4:00 AM to 6:00 PM; evening: 6:00 PM to 4:00 AM the next morning), and not overlapping another of the Talent's open or ongoing gigs, including a one hour gap after each gig. A request that does not meet these conditions is declined with the reason. Availability is set by the Talent, and Jagigs does not guarantee that a Talent will accept any request.
6.2 Booking fee. Every booking includes a nonrefundable booking fee, currently 7% of the Talent's listed price for that booking, charged to the Client at the time of booking. This fee compensates Jagigs for operating the Platform and is retained by Jagigs regardless of what later happens to the booking (including if the Talent rejects it, or the booking is cancelled).
6.3 Jagigs' share of the Talent's price. Jagigs retains a share of the Talent's listed price (currently 8%) as its own compensation for facilitating the booking and paying the Talent; the remainder is what Jagigs pays the Talent once a gig is completed by both parties.
6.4 Cancellations by a Client. Where a Client cancels a paid booking before it has started, a refund is issued according to how close to the event the cancellation happens. A cancellation made well in advance is refunded in full (excluding the nonrefundable booking fee). A late cancellation (close to, or after, the scheduled start time) results in the Talent receiving a portion of the price as compensation for the reserved time, with the remainder refunded to the Client. The exact thresholds and proportions are set out in the Platform and may be updated from time to time; the current rule reserves 30% of the Talent's price as compensation to the Talent for a late cancellation, refunding the remaining 70% to the Client.
6.5 Rejections. If a Talent rejects a booking after it has been paid for, the amount paid for that Talent's price is refunded to the Client (the booking fee remains nonrefundable).
6.6 Missed gigs. If a paid booking is not started by either party within its scheduled start window, it is automatically closed as "missed" and the Client's payment for the Talent's price is refunded (the booking fee remains nonrefundable).
6.7 Changing a booked gig. Before a gig starts, the Client and Talent may agree to change its date and time, its location, or both. Either party may propose a change and it only takes effect if the other accepts it; a proposal that is not answered within the time shown in the app lapses. A booking can be changed a limited number of times (currently 2), the new time must still be one the Talent is available for (Section 6.1), and a change does not by itself entitle either party to a refund. A Client may also update the booking's notes for the Talent before the gig starts; the Talent is notified of the update.
6.8 Group bookings. A Client may book several Talents for the same event as a single group booking. Each Talent's booking within a group is otherwise treated as its own individual booking for the purposes of availability, acceptance, payment, cancellation, and rating, except where the Platform explicitly treats the group as a whole (for example, starting or ending every gig in the group together).
6.9 Transfer costs. Where a payout or refund is sent by mobile money transfer, any transfer cost charged by the payment processor for that specific transfer may be deducted from the amount the recipient receives.
7. LOCATION AND SEARCH
7.1 How location is used. Clients can search for Talents near their current location, near their saved address, or near any place they search for, and can sort or limit results by distance. To make this possible, each Talent's profile address is used to calculate an approximate distance.
7.2 What other users see. Other users see only the general area of your address (for example, a neighbourhood and town) and a rounded distance; your full address is never shown to them. A Talent without a saved address may not appear in location-based searches.
7.3 Event locations. The event address for a booking is shared with the Talent booked for that event so they can attend.
8. RATINGS AND REVIEWS
After a gig is completed, both the Client and the Talent may rate and review each other within 14 days. Ratings and reviews become visible once both parties have submitted them, or after that period has passed, and must relate to the actual gig experience. Ratings are shown on a Talent's profile and listings (including an average for each of their gigs), and reviews about a person as a Client or as a Talent may be shown on their profile. Reviews may not contain contact details, web links, offensive or abusive language, or attempts to arrange dealings outside the Platform; such content is blocked or may be removed.
9. COMMUNICATIONS AND NOTIFICATIONS
9.1 Messaging. In app messaging is provided so Clients and Talents can coordinate a booking. You agree not to use messaging, reviews, gig descriptions, booking notes, or any other part of the Platform to share personal contact details (phone numbers, emails, social media handles or usernames, external links), to solicit or agree to deal with another user outside the Platform in connection with a service that should be booked through it, or to send offensive, abusive, or insulting language. Jagigs automatically screens messages and content for this and other prohibited content described in Section 12, and messages that break these rules are not sent.
9.2 Notifications. By using the Platform you agree that Jagigs may send you service notifications about your account, bookings, payments, messages, ratings, and security (for example, password reset codes and account changes) by in app alert, push notification, email, and, for important booking events, SMS. These are part of how the Platform works; you can control push notifications in your device settings.
10. JAGIGS SPOTLIGHT
The Platform includes a "Jagigs Spotlight" section with announcements, promotions, and featured Talents or categories chosen by Jagigs. Being featured is at Jagigs' discretion and is not an endorsement or guarantee of any Talent. Some Spotlight items open a web page inside the app; Jagigs is not responsible for the content or practices of websites it does not operate.
11. TALENTS ARE INDEPENDENT CONTRACTORS
11.1 No employment relationship. A Talent is an independent contractor, not an employee, worker, partner, joint venturer, or agent of Jagigs. Nothing in these Terms, and nothing about how a Talent uses the Platform, creates an employment or agency relationship between Jagigs and that Talent.
11.2 Talents control their own services. A Talent is solely responsible for the manner, quality, and performance of the services they provide to Clients, for keeping their availability accurate, and for their own equipment, transport, conduct, taxes, business registration, licences, permits, and insurance, and for complying with all laws applicable to their services. Jagigs does not direct, supervise, or control how a Talent performs at an event.
11.3 Jagigs is not a party to the service performed. The actual entertainment or event service booked is an arrangement between the Client and the Talent. Jagigs is not a party to that service, does not guarantee its quality, timeliness, or suitability, and (except where these Terms expressly provide for a refund or compensation under Section 6) is not responsible for a Talent's performance or a Client's conduct at an event.
12. PROHIBITED CONDUCT
You agree not to: provide false information, including a false address or location; impersonate another person; circumvent the Platform's booking or payment process; harass, threaten, insult, or discriminate against another user; post unlawful, obscene, offensive, or infringing content; attempt to manipulate ratings or search results; access or attempt to access another user's account or data; interfere with the Platform's operation or security; or use the Platform for any unlawful purpose. Jagigs may suspend or terminate any account that violates these Terms, withhold or reverse a payout connected with a violation, and take any other action reasonably necessary to protect the Platform and its users.
13. INTELLECTUAL PROPERTY
The Platform, its software, design, and branding are owned by Jagigs and protected by applicable intellectual property laws. You retain ownership of content you upload (such as gig photos, videos, and descriptions), but grant Jagigs a licence to host, display, and use that content to operate and promote the Platform, including in Jagigs Spotlight. This licence ends for your content when it is deleted, except for copies Jagigs is required to keep by law.
14. DISCLAIMERS AND LIMITATION OF LIABILITY
The Platform is provided "as is." To the fullest extent permitted by law, Jagigs disclaims all warranties, express or implied, regarding the Platform and the services booked through it, including any warranty of merchantability, fitness for a particular purpose, or noninfringement. Jagigs does not guarantee that a Talent will attend, perform to a Client's expectations, or that a Client will pay outside the ordinary payment flow, and distances and areas shown in location search are approximate. To the fullest extent permitted by law, Jagigs' total liability to you for any claim arising from your use of the Platform is limited to the amount of fees Jagigs actually retained (the nonrefundable booking fee and Jagigs' share described in Section 6.3) in connection with the specific booking giving rise to the claim. Jagigs is not liable for indirect, incidental, special, or consequential damages.
15. INDEMNIFICATION
You agree to indemnify and hold Jagigs harmless from any claim, loss, or damage (including reasonable legal costs) arising from your breach of these Terms, your use of the Platform, the services you provide or receive through the Platform, or your violation of any law or third party right.
16. DELETING YOUR ACCOUNT, SUSPENSION AND TERMINATION
16.1 Deleting your account. You can delete your account at any time in the app (Profile Settings, then Delete account), after confirming with your password (or, for accounts created with Google sign-in, by typing DELETE). Deletion takes effect immediately and cannot be undone. It is not available while you have a gig that is still pending, accepted, paid, or in progress, or while Jagigs still owes you a refund or payout; the app tells you what needs to be finished first.
16.2 What deletion does. When your account is deleted, your personal details are removed from it, your gigs are taken down and their photos and videos deleted, you are signed out on every device, and your email address is released so it can be used to sign up again. Records of past bookings, payments, payouts, and ratings are kept without your personal details where Jagigs needs them for legal, accounting, tax, or dispute purposes, as described in our Privacy Policy. You will receive an email confirming the deletion.
16.3 Suspension and termination by Jagigs. Jagigs may suspend or terminate your account, or restrict your access to any part of the Platform, at any time, with or without notice, for a breach of these Terms, suspected fraud, or to comply with law.
16.4 Survival. Sections of these Terms that by their nature should survive deletion or termination (including Sections 5, 6, 11, 14, and 15) will survive.
17. CHANGES TO THESE TERMS
Jagigs may update these Terms from time to time. Where a change is material, you will be asked to review and accept the updated Terms before continuing to use the Platform; each version of these Terms carries a version number and date, and your acceptance of a specific version is recorded against your account.
18. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of the Republic of Ghana. Any dispute arising out of or relating to these Terms or the Platform that cannot be resolved informally will be subject to the exclusive jurisdiction of the courts of Ghana.
19. CONTACT
Questions about these Terms can be sent to support@jagigs.com.
